FANTESTICO PRIVACY POLICY

This privacy policy for Fantestico’s online platform related to its implementation and provision of health and wellness online lab tests search services (this “Privacy Policy”) describes the ways in which Fantestico, Inc., a Delaware corporation, and its subsidiaries and affiliates (collectively, “Fantestico,” “we,” “us,” or “our”), collect, use, share, and store information, including Personal Information about you. “Personal Information” as used herein means any information that identifies, relates to, or describes, directly or indirectly, is reasonably capable of being associated with, or could reasonably be linked, to a particular prospective, current, or former customer of the Fantestico Services, as such term is defined below.

“Personal Information” does not include information we process solely on behalf of our customers, including personal information about individuals who communicate with our customers through the use of the Fantestico Services. Data protections laws, such as those required under the European General Data Protection Regulation (“GDPR”) or the California Consumer Privacy Protection Act (“CCPA”), generally distinguishe “controllers” from “processors” and “businesses” and “service providers” of Personal Information. Controllers and businesses are in control of deciding why and how to process Personal Information that they may need, such as the Personal Information of their own service providers or interview team members. However, processors or service providers process such Personal Information at the direction and on behalf of the businesses requesting the services.

With regard to any information that we process solely on behalf of our customers, including any information that could otherwise be used to identify a particular individual, we are only acting as a processor or service provider under such data protection laws, and this Privacy Policy shall not apply to the collection or use of such information. Any questions or concerns related to the collection, storage, use, control, or processing of such information must be directed to the company that is the controller of such information.

This document provides guidance regarding how we collect and use information from our public websites, including without limitation www.fantesti.co and www.fantesti.com (collectively, the “Websites”), and from the use of any products and services offered therein (collectively, the “Fantestico Services.”). By using the Websites, you agree to such collection and use of such information as further described hereunder.

Our Pledge on Privacy

We will be transparent about the different types of information we collect and how we use them. We will ask your permission before sharing your Personal Information with third parties for purposes other than the purpose for which the information was originally requested, or to provide the Fantestico Services, and to do so only when we think they will provide you with a welcome additional service. By browsing the Websites or otherwise engaging with Fantestico for the use of any of the Fantestico Services, you agree to allow us to collect and process information as described in this Privacy Policy.

Consent to international data transfers
Personal Information provided by you may be collected, processed, and stored by Fantestico or its service providers in the United States and other countries where servers we own or use may reside. Please be aware that the privacy protections and legal requirements, including the rights of authorities to access your Personal Information, in some of these countries may not be equivalent to those in your country. If you are browsing the Websites or are otherwise engaging with Fantestico for the purchase of any of the Fantestico Services in Europe or other regions with laws governing data collection and use that may differ from United States law, you consent to the transfer of your personal data to the United States and other countries where Fantestico operates.

No Permitted Use by Minors

The Websites are not directed at, and are not intended for the use of anyone below the age of 18. If you are not at least 18 years old, you are not permitted to use the Websites or engage with us for the Fantestico Services, and we ask that you please do not provide any information or data to us, personal or otherwise.

Information Collected by the Websites

The Websites collect anonymous data as well as Personal Information. We do not collect Personal Information without you first taking an action that demonstrates your prior consent — such as clicking a “submit” button on a web form.

Any time you enter Personal Information in a form on one of the Websites, we collect that information and store it on servers that are encrypted and maintained by our data center partners or those of our third-party vendors. Examples of Personal Information that you may provide when submitting information to us include:

We may also use clear gifs in HTML-based emails sent to our customers or other contacts in order to track which emails are opened and which links are clicked by recipients. This information allows for more accurate reporting and improvement of the Websites, engagement for the purchase or use of Fantestico Services, and our marketing efforts. We may also collect analytics data, or use third-party analytics tools, to help us measure traffic and usage trends of the websites and engagement for the purchase of Fantestico Services. These tools collect information sent by your browser or mobile device, including the pages you visit, your use of third-party applications, and other information that assists us in analyzing and improving the Websites and access of Fantestico Services. Although we do our best to honor the privacy preferences of our customers, we are not able to respond to Do Not Track signals from your browser at this time, as we believe that there is no consistent industry standard for how to respond to Do Not Track browser settings.

You can “opt out” of the collection of any information through cookies or other tracking technology by actively managing the settings on your browser or mobile device. Fantestico’s Use of Information

We use the information we collect throughout the process to provide the Fantestico Services, including without limitation the listing and displaying of health and wellness lab test products and services provided by third parties based on your search criteria. However, to some extent, such services may be rendered by third parties, such as third-party advertisers. Since we do not control such third parties, and likewise do not assume any liability for their conduct, we highly recommend you review their privacy policies to understand how they use your information.

We also use such information to improve your experience in searching for third-party products and services through Fantestico, including to relay assessments and recommendations to third parties offering such services or products. We may use your contact details to ask you to participate in surveys about your Fantestico use, and to send you other communications and promotions from Fantestico.

We may also use this information in an aggregated, non-identified form to develop new content and materials, for research purposes, and to help us make development, marketing, and business decisions.

We may use service providers to perform some of these functions. Those service providers are restricted from sharing your information for any other purpose.

We use industry-standard methods to keep this information safe and secure while it is transmitted over your local area network and through the Internet to our servers. Depending on your location and type of data, Fantestico may process the Personal Information that you provide us on servers that are not in your home country.

Sharing of Information Provided to Fantestico

Under no circumstance do we share Personal Information for any commercial or marketing purpose unrelated to the purchase and delivery of the Fantestico Services without asking you first. We do not rent or sell our customer lists.

We may share Personal Information when we have your consent.

As part of business transitions
Upon the sale or transfer of the company and/or all or part of its assets, Personal Information that you provide us may be among the items sold or transferred. We will request a purchaser to treat our data under the Privacy Policy in place at the time of its collection.

For legal reasons
We may provide information to a third party if we believe in good faith that we are required to do so for legal reasons. For example, we may disclose information in response to legal process and we may disclose information in response to lawful requests by public authorities in the United States and other countries for the purposes of law enforcement and national security.

We may share non-Personal Information (for example, aggregated or anonymized customer data) publicly and with our partners. For example, we may publish articles or information about health lab testing trends within a given timeframe. We may also share non-Personal Information with our partners, for example, if they are interested in providing demand-response services. We take steps to keep this non-Personal Information from being associated with you and we require our partners to do the same.

Consumer Choices and Control Over Personal Information

All Personal Information is encrypted as it is transmitted to Fantestico and cannot easily be accessed.

Fantestico generally stores Personal Information on Fantestico’s servers until you request that it be deleted or edited, or for as long as you remain a Fantestico customer in order to provide you with any Fantestico Services.

However, for companies that transmit Personal Information of their own clientele, the management of such information related to their service providers is the responsibility of the company using the Fantestico Services.

Notwithstanding the foregoing, if you believe that any company is using your Personal Information without your authorization, please feel free to reach out to us at info@fantesti.co so that we may investigate the matter further.

You can amend or delete your Personal Information from Fantestico’s servers by contacting Fantestico directly at info@fantesti.co. We will accommodate any such requests unless we are legally required to retain such Personal Information. Additionally, because of the way we maintain certain Fantestico Services, after your information is deleted, backup copies may linger for some time before they are permanently deleted.

Changes to Fantestico’s Privacy Policy

This Privacy Policy may change from time to time at our sole and absolute discretion. We make efforts to provide notice of any changes on the Website or by contacting you, but you can always reference this statement on the Website.

Rights of California Residents

If you are a California resident, you have additional rights under the California Consumer Privacy Protection Act (“CCPA”). Pursuant to CCPA, California residents may request any of the following from us:

  • A copy of all personally identifiable information we have on file
  • A list of all third parties to whom we have shared your Personal Information during the previous 12-month period for marketing purposes (though to reiterate, we do not sell your Personal Information for this purpose)
